These terms and conditions (the "Terms") govern the use of www.qualityrugsandfurnituresyd.com.au (the "Site"). This Site is owned and operated by Quality Rugs & Furniture Sydney. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and agree to abide by them at all times.

THESE TERMS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT AFFECTS HOW DISPUTES ARE RESOLVED. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on our Site is the property of Quality Rugs & Furniture and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Sale of Goods

These Terms govern the sale of goods available on our Site, including furniture, couches, bedroom, living room, dining room, office and outdoor furniture, decor, rugs and accessories.

These Terms apply to all goods displayed on our Site at the time you access it, including products listed as out of stock. All information, descriptions and images we provide about our goods are as accurate as possible. Product images are a representation only, and colour, shade and texture may vary (see our Refund Policy).

We reserve the right to modify, reject or cancel your order where necessary. If we cancel your order and have already processed your payment, we will refund the amount you paid. You agree that it is your responsibility to monitor your payment method to verify receipt of any refund.

Payments

We accept the following payment methods on our Site: credit card, debit card, PayPal, Apple Pay, American Express, Afterpay and Zip Pay.

When you provide us with your payment information, you authorise our use of and access to the payment method you have chosen, and authorise us to charge the amount due. If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse your transaction.

Accounts

When you create an account on our Site, you agree that you are solely responsible for your account and the security of your password and any sensitive information attached to it, and that all personal information you provide is up to date, accurate and truthful. We reserve the right to suspend or terminate your account if you use our Site illegally or violate these Terms.

Shipping and Delivery

Goods purchased from our Site are delivered by one of the following methods:

  • Freight delivery: 7–10 business days (free shipping on rug orders over $99)
  • Pickup from our Lidcombe or Marsden Park store: 2–5 business days

Delivery will take place as soon as reasonably possible. Delivery times may vary due to unforeseen circumstances and do not include weekends and public holidays. Delivery charges are payable in addition to the price of the goods, unless free shipping applies.

You must provide a complete and accurate delivery address, including the recipient's name. We are not liable for delivery to the wrong address or person where you have provided inaccurate or incomplete information.

Refunds and Returns

Refunds, returns and exchanges are handled under our Refund Policy. In-store returns and exchanges can be made at:

Consumer Protection Law

Where the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other consumer protection legislation applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. If there is a conflict between these Terms and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

To the extent permitted by law, Quality Rugs & Furniture and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses, including legal fees, arising from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Quality Rugs & Furniture and our directors, officers, agents, employees, subsidiaries and affiliates from any actions, claims, losses, damages, liabilities and expenses, including legal fees, arising out of your use of our Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia.

Dispute Resolution

Subject to any exceptions in these Terms, if you and Quality Rugs & Furniture are unable to resolve a dispute through informal discussion, we both agree to submit the issue first to a non-binding mediator, and to an arbitrator if mediation fails. The arbitrator's decision will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both of us. The costs of mediation or arbitration will be paid by the unsuccessful party. Both of us retain the right to bring an action in a small claims tribunal (including NCAT) and to bring an action for injunctive relief or intellectual property infringement.

Severability

If any provision of these Terms is found to be inconsistent or invalid under applicable law, that provision will be deemed void and removed, and all other provisions will remain valid.

Changes

We may amend these Terms from time to time to maintain compliance with the law and to reflect changes to how we operate our Site. We will notify users by email or by posting a notice on our Site.
